Street vendors are a significant component of the urban informal economy in Indonesia, yet their presence is frequently treated as a threat to public order, road function, and urban aesthetics. Regional governments generally respond through relocation, enforcement, and empowerment, but implementation often faces limited relocation sites, inadequate communication, low vendor participation, and repressive enforcement. This study analyses the legal framework governing street vending in Indonesia and evaluates it from the perspective of siyāsah sharʿiyyah, Islamic public-policy jurisprudence. It applies normative legal research using statutory, conceptual, and comparative approaches to the 1945 Constitution, the Regional Government Law, the Micro, Small and Medium Enterprises Law, Presidential Regulation No. 125 of 2012, Minister of Home Affairs Regulation No. 41 of 2012, Government Regulation No. 16 of 2018 on the Municipal Police Unit, ILO Recommendation No. 204, and literature on siyāsah, ḥisbah, and the informal economy. The findings show that the national framework mandates both arrangement and empowerment, but regional practice tends to emphasise enforcement and relocation without guaranteeing livelihood continuity. From the perspective of siyāsah sharʿiyyah, such policies do not yet fully satisfy the principles of maṣlaḥah, justice, consultation, and protection of vulnerable groups. The study proposes a Maṣlaḥah-Based Street Vending Governance Model consisting of recognition and registration, negotiated spatial allocation, graduated and humane enforcement, relocation with livelihood guarantees, and consultation and grievance forums.
